General Terms and Conditions of Sale

1. COMPANY  IDENTITY

GOOSSENS PARIS SAS is a French simplified joint-stock company, with capital of 37,000 Euros, having its registered office at 10, rue du Cheval Blanc in Pantin (93500), registered under Number 480 479 914 with the Bobigny Trade and Companies Register.

GOOSSENS PARIS is an art studio specialising in the design, development, manufacture and marketing of items of jewellery, goldware and silverware. Its APE code (Principal Activity Code) is 4777Z.

The Intra-Community VAT number of GOOSSENS PARIS is FR63 480 479 914.

 

2. PURPOSE

These General Terms and Conditions of Sale define the rights and obligations of the parties with regard to the on-line sale of products from the GOOSSENS PARIS range on the website www.goossens-paris.fr (hereinafter “the Website”).

Therefore, the placing of an order by anybody (hereinafter “the Customer”) of a product for sale on the Website shall imply full acceptance of these General Terms and Conditions of Sale, which the Customer shall acknowledge having read prior to his/her order.

The General Terms and Conditions of Sale which apply are those in force on the day the Customer’s order is validated. Prior to his/her order, the Customer declares that s/he has full legal capacity enabling him/her to commit to these General Terms and Conditions of Sale. GOOSSENS PARIS reserves the right to amend these General Terms and Conditions of Sale at any time, the amendments then being applicable to any orders after this amendment.

The resale or the distribution of the GOOSSENS PARIS products bought on the Website is strictly forbidden. If you are a retailer or a distributor, the Sales Department at GOOSSENS PARIS is available on +33(0)1.49.15.11.34 for further information.

 

3. ACCESS TO THE WEBSITE AND ORDERING METHOD

The Customer shall place his/her order on our website at: www.goossens-paris.fr accessible 24/7 (except for technical reasons).

The information given by the Customer and recorded by GOOSSENS PARIS during registration and/or the order shall be considered as proof of the transactions between GOOSSENS PARIS and the Customer. After the Customer has validated the order, GOOSSENS PARIS shall send the Customer a confirmation e-mail to notify him/her that the order has been received.

The validation of the purchase order shall be considered as confirmation of the Customer’s order. It shall imply acceptance of these General Terms and Conditions of Sale. GOOSSENS PARIS reserves the right to refuse to carry out a delivery or to fulfil an order if the Customer has not paid all or part of a previous order, or if there is an ongoing dispute over payment.

All information gathered by the Website is for the exclusive use of GOOSSENS PARIS, and will enable the Customer’s order to be processed correctly. The Customer is free to request that his/her account with GOOSSENS PARIS be deleted, by sending an e-mail to: commercial@goossens-paris.fr or by telephone on +33(0)1.49.15.11.34.

5. DELIVERY ZONE

GOOSSENS PARIS delivers to France, all of Europe and the rest of the world. In the case of an order to a country other than France, the Customer is the importer of the product(s) concerned. Customs duties, local taxes, import duties or State taxes may have to be paid. GOOSSENS PARIS is not responsible for these duties and sums. They are to be paid by the Customer and are entirely the responsibility of the Customer both in terms of declaration and payment to the relevant authorities and organisations in the Customer’s country.

 

6. PRICES AND PAYMENT

 

PRICES

The prices of our products are shown in Euros; they include all taxes for France and exclude taxes for the other countries. The prices may be changed at any time without prior notice. However, the products shall always be invoiced at the current price at the time the order is validated.

The prices do not include delivery charges, which are invoiced in addition to the price of the purchased products and indicated before the order is recorded. The delivery charges vary according to the Customer’s delivery address.

 

PAYMENT

The Customer has the following payment options: Credit or debit card (Visa, Mastercard, CB, Eurocard), PayLib

GOOSSENS PARIS uses a remote data encryption payment method with the 3D Secure system. Consequently, payments by debit or credit card are not made on our servers, but directly on those of our bank (Mercanet solution – BNP) in a secure environment. This guarantee ensures that your bank card numbers are only known by our bank.

Payment must be made in full at the time the order is placed by the Customer and shall be paid in Euros. The Customer undertakes to pay the price of the ordered items and the associated delivery charges. The bank or credit card shall be debited at the time of the order. If all or part of the order cannot be delivered for reasons best known to itself, GOOSSENS PARIS undertakes to give a refund for the undelivered items and the associated shipping costs.

The Customer guarantees GOOSSENS PARIS that s/he is authorised as necessary to use the card payment method at the time the order is placed. As part of the measures taken to prevent fraud over the Internet, GOOSSENS PARIS reserves the right to request a photocopy of a proof of identity and proof of address, for all payments.

 

7. THE PRODUCTS

The products sold by GOOSSENS PARIS are products designed and developed by the teams at GOOSSENS PARIS. Some products available on the Website are unique products, made from natural stones. Some are available in several colours and are made by hand at the Customer’s request.

The Customer acknowledges and accepts that GOOSSENS PARIS shall fulfil his/her order while stocks last: stock of finished or half-finished products for items on order.

Certain items may present irregularities inherent in the manufacturing of hand-made products which cannot be described as major defects.

If a product is unavailable after confirmation of the order concerned, GOOSSENS PARIS shall inform the Customer by e-mail or by telephone of the partial delivery of his/her order or of its cancellation. If certain ordered items are unavailable, only the prices and shipping costs for the available products shall be debited.

 

 

8. DELIVERY

GENERAL

The products purchased from the Website are delivered by carrier, at the Customer’s expense.

It is also possible to collect them from the GOOSSENS PARIS store, situated at 42, avenue George V in Paris (75008).

The products are delivered to the delivery address given during the order process. Our delivery charges are calculated according to the delivery address. Should there be a mistake in the delivery details, GOOSSENS PARIS shall not be held liable for the impossibility of delivery. In this event, the costs incurred for a new delivery shall be payable by the Customer.

For reasons of security in particular, GOOSSENS PARIS shall not process any order for which a PO Box or a Cedex address is provided.

Should the Customer order several products at the same time and the shipments be at different times, GOOSSENS PARIS reserves the right to split these shipments, with the shipping costs being invoiced on the basis of one single consignment.

 

CHECKING OF THE CONDITION OF THE PACKAGE UPON DELIVERY

The delivery note given by the carrier, dated and signed by the Customer upon delivery of the order, shall be considered as proof of shipment and delivery. By signing the delivery note, the Customer certifies that the delivered items are in perfect condition, and that the delivery has been made in accordance with the shipper’s terms and conditions of sale. No complaint about damage during transportation shall be accepted without any precise annotations on this delivery document by the Customer. It is the Customer’s responsibility to carry out all checks and state any reservations upon the arrival of the material and, where necessary, to pursue all remedies.

In the event of a claim concerning any defects or damage to the products (damage in transit, broken products, etc.), the Customer should note his/her comments on the delivery note and contact the Customer Service Department by e-mail or telephone within a maximum of 8 days after receipt of the products: GOOSSENS PARIS, Service Client E-Shop, 10, rue du Cheval Blanc, 93500 Pantin, Tel.: +33(0)1.49.15.11.34, @: commercial@goossens-paris.fr

All returned merchandise requires the prior agreement of GOOSSENS PARIS. In any event, merchandise shall be returned at the Customer’s own cost and risk, except for a return due to a problem with the products delivered (mistake, faulty product). Any damaged item must be returned to GOOSSENS PARIS, even if it was delivered completely broken. Upon receipt of the item and after checking the damage, we shall exchange it or offer a refund, depending on the Customer’s choice.

COLLECTION IN THE EVENT OF ABSENCE

If the recipient is absent upon delivery, the carrier shall leave a delivery notice at the delivery address given by the Customer. The order should be collected from the address and in accordance with the terms and conditions given by the carrier. If the order is not collected within the time limit specified by the carrier, it shall be returned to GOOSSENS PARIS.

DELIVERY DATES

The average time for preparing the order is approximately 48 hours (working days – apart from August) for products in stock.

The average delivery times (for information purposes only) departing from GOOSSENS PARIS are as follows:

          12 to 72 hours in mainland France

          2 to 4 days for delivery outside mainland France

 

The ordered products shall be delivered within a maximum of thirty days from the day the order was recorded, subject to full payment of the price. If delivery has not been made within this specified time, the Customer may cancel his/her order. The sums paid by the Customer shall then be immediately refunded to him/her, to the exclusion of any further compensation.

 

DELAY / NON-DELIVERY

Although GOOSSENS PARIS cannot be held liable for any delay or non-delivery, the Customer should inform the Customer Service Department of this by e-mail (commercial@goossens-paris.fr) as soon as possible. GOOSSENS PARIS shall endeavour to enforce the insurance arrangements covering the carrier concerned.

 

Any claims made 30 calendar days after the date the Customer’s order was validated cannot be taken into account.

 

DELIVERY CHARGE :

The delivery charges are as follows :

          €15 for delivery in mainland France

          €25 for delivery outside mainland France

 

9. PRODUCT QUALITY AND CONFORMITE

GOOSSENS PARIS makes every effort to ship quality products in appropriate packaging. Each order is checked with the utmost care.

GOOSSENS PARIS promises to refund the shipping costs incurred by the Customer for the delivery of the product(s), alongside the purchase price of the product, in the event of a shipping error such as a missing product in the order or a received product which does not comply or a product with a manufacturing fault. The product should be returned intact in its original packaging. The Customer Service Department will have been previously notified by the Customer within a maximum of 8 days after receipt of the aforementioned products.

The fault claimed by the Customer should not be the result of:

–          abnormal or non-compliant use.

–          wear and tear or normal ageing

–          an accidental event or an external cause in general (such as the intervention of any unauthorised third party on the product).

The Customer may come to the Store to get any faults assessed. He/she shall also be able to contact the Customer Service Department by telephone or e-mail, and return the product to the GOOSSENS PARIS studio, only upon request by the Customer Service Department. The shipping costs for this return shall be payable by the Customer.

The Customer Service Department shall then contact the Customer to inform him/her of the result of the assessment and to offer a suitable solution to the problem.

10. RETURN : EXCHANGE – REFUND

RIGHT TO CANCEL / REFUND

The Customer has a period of 14 clear calendar days from receipt of the ordered items to exercise his/her right to cancel, without having to give any reasons or pay any penalties, by returning the items to GOOSSENS PARIS to obtain a refund.

The Customer may return the purchased product within the aforementioned period, as evidenced by the date appearing on the delivery note, subject to the following conditions:

–          the items should be returned intact, in their original condition,in their original packaging and complete, so that the product can be put on sale again as new

–          the products should be returned to the following address: GOOSSENS PARIS, E-SHOP, 10, rue du Cheval Blanc, 93500 Pantin

–          the sums paid by the Customer, including the delivery costs, shall be fully refunded, by crediting the bank card used for the order. The return charges shall be payable solely by the Customer

–          the Customer may opt, upon proposal from GOOSSENS PARIS, for another method of reimbursement in the form of a credit note. This credit note will only be valid on the Website. The credit note will not be valid at the GOOSSENS PARIS store situated at 42, avenue George V, 75008 Paris, or at any of the brand’s retailers.

–          If just one part of the items is returned, the delivery charges shall not be refunded by GOOSSENS PARIS as the Customer has benefited from the delivery service for the items kept

–          In the case where items are returned after the 14-day cancellation period as well as in the case of items returned under the right to cancel which have been returned in a damaged condition, damaged by the Customer, the latter shall not be refunded and shall be informed that the products remain available to him/her for a period of one month. Upon the Customer’s request, these items may also be shipped back to him/her at his/her expense.

It is stipulated that no matter who is the end recipient of the item acquired by the Customer, the right to cancel may only be exercised by the Customer.

EXCHANGE :

The Customer has a period of 14 clear calendar days from receipt of the ordered items to arrange an exchange.

The Customer may return the purchased product within the aforementioned period, as evidenced by the date appearing on the delivery note, subject to the following conditions:

–          the items should be returned intact, in their original condition,in their original packaging and complete, so that the product can be put on sale again as new

–          the products should be returned to the following address: GOOSSENS PARIS, E-SHOP,

–          The Item may be exchanged at the GOOSSENS PARIS store, situated at 42 avenue George V, 75008 Paris, for a product of identical value, within a maximum of 14 days from the order date, upon presentation of the invoice and the intact product presented in its original packaging.

–          It will not be possible to obtain a refund at the GOOSSENS PARIS store (Paris)

–          The shipping charges shall be payable by the Customer

–          In the case of returned items, in the event where the items have been returned in a damaged condition, damaged by the Customer, the latter shall not be offered an exchange. The Customer shall be informed that the products remain available to him/her for a period of one month. Upon the Customer’s request, these items may also be shipped back to him/her at his/her expense.

 

11. TRANSFER OF OWNERSHIP

The ordered products remain the property of GOOSSENS PARIS until GOOSSENS PARIS has received full payment of the price.

12. DATA PROTECTION AND FREEDOM OF INFORMATION

The information requested by GOOSSENS PARIS is essential for handling the order. In accordance with the French “Data Protection and Freedom of Information” Law of 6 January 1978, the Customer has the right to access, amend, correct and remove data concerning him/her held by GOOSSENS PARIS.

13. INTELLECTUAL PROPERTY

The Website and each of its components, including but not limited to the texts, images, photographs, illustrations, and, where applicable, sounds, music and the underlying technology are, unless stated otherwise, the sole property of GOOSSENS PARIS or its partner companies. Consequently, in accordance with the provisions of the French Intellectual Property Code, and the legislative and statutory provisions of all countries and international conventions, any reproduction and representation, including any downloading and any transmission by any means whatsoever, in part, in full and/or modified of the Website or any of its component elements, is prohibited as well as their adaptation or translation.

The company names, brands, logos and distinctive signs appearing on the Website are protected by law; any reproduction or use of all or part of these elements, in any way and in any capacity, is strictly prohibited. In accordance with the laws in force, no person, subject to prosecution, shall reproduce in full or in part the designs by GOOSSENS PARIS.

14. LIABILITY

The products offered by GOOSSENS PARIS comply with current French legislation. GOOSSENS PARIS cannot be held liable in the event of failure to abide by the contract following a shortage of stock, a case of force majeure, a full or partial strike by the postal services or carriers, computer failure or the breakdown of telecommunications including networks and especially the Internet, or the legislation of the country where the products are delivered.

As the Website is hosted by an external provider, GOOSSENS PARIS may not be held liable for any interruption in the service of the Website, malfunction of the Website, inaccuracy or omission concerning the information available on the website or for any damage resulting from a fraudulent intrusion of a third party leading to a modification of the information displayed on the site. GOOSSENS PARIS may not be held liable for any indirect damages that may arise from the purchase of the products. In the case of hyperlinks to other websites from the Website, the Website shall not be responsible for the content of the information provided on these websites after activation of these links.

15. SETTLEMENT OF DISPUTES

These General Terms and Conditions of Sale are subject to French law. The parties shall endeavour to settle any differences amicably relating to the interpretation, execution or termination of the contract concluded between them. If no amicable agreement is reached, the dispute shall be submitted to the appropriate courts under the conditions of common law.
